Legal Advice About Income Tax
Many individuals and business owners do not contact a tax lawyer regarding their corporate or personal income taxes until an event triggers the call. An audit is a common trigger. A lien on a home or bank account levy is another trigger.
At The Litwin Law Firm, P.C., we have experience with audits and appeals for Georgia individuals and corporate income taxpayers. Attorney Richard Litwin focuses on taxation law, including such issues as:
- A notice requesting additional information about a previous tax return is a warning sign.
- An audit is a clear alert to discuss your potential tax liability with an experienced taxation lawyer.
- A Department of Revenue request for a listing of your company's officers should be taken seriously.
Pay Attention to Warning Signs
There are warning signs that you should take seriously should they ever occur. A nexus questionnaire is a warning sign that you should take seriously.
Nexus means a connection — a link or tie — that a business has with another state for purposes of requiring the business to collect the state's sales and use tax and/or pay income tax. A nexus questionnaire is designed to give the Department of Revenue specific information necessary to determine whether a link exists to establish a tax obligation.
Your responses to a nexus questionnaire could show that your business in Tennessee, for example, owes corporate income tax in Georgia. Or it may show that a worker in Florida owes income tax to the Georgia Department of Revenue. There are other warning signs that you should take seriously:
Keep in mind that a CPA cannot provide legal advice, and only an attorney can represent you in court. We do not recommend that you act as your own attorney if you are facing legal action. Further, businesses are not permitted to represent themselves in court in Georgia.
